Constitution

The MUTUK Constitution is the foundational legal document that governs the Mutual Union of Tiv in the United Kingdom (MUTUK). It outlines the organisation's structure, objectives, membership guidelines, leadership roles, decision-making processes, and operational rules.

15. Executive Committee Elections

The election of all officers of the Executive Committee shall be conducted biennially at an annual general meeting of the society in line with the following procedure:

  • Section 15(a): The Electoral Committee, shall be appointed by a simple majority, shall preside over the elections in line with the guidelines and procedures approved by the members.
  • Section 15(b): All members present at the meeting at which the elections are held shall be entitled to vote and be voted for in the election.
  • Section 15(c): Pre-voting and voting by proxy shall be permitted so long as the integrity of the relevant votes is guaranteed.
  • Section 15(d): The following positions shall be elected:
  • President
  • Vice President
  • Secretary General
  • Assistant  Secretary General
  • Publicity Secretary
  • Treasurer
  • Financial Secretary
  • Social Secretary
  • Chief Whip
  • Welfare Secretary
  • Legal Advisor
  • Section 15(e): All nominations must be made by a member and must be submitted to the Electoral Committee no later than two weeks to the date of the election. Such nominations must be made in writing (this includes email).
  • Section 15(f): In order to be valid, all nominations must be seconded by a different member to that, who did the original nomination.

16. Voting

During any election of the Executive Committee, the following rules shall apply:

  • Section 16(a): To vote and be voted for, a member must have been registered at least 1 month prior to the date of the election. The Society can waive this provision if it is expedient, in an emergency or general meeting by a special resolution.
  • Section 16(b): Candidates will be granted the opportunity to address the general assembly on the day of the elections. The order and time slot for such statements shall be determined by the Electoral Committee.
  • Section 16(c): Candidates for all offices shall be deemed to be elected by majority votes cast.
  • Section 16(d): A rerun shall be held in the event that there is a tie for any of the offices.
  • Section 16(e): Voting shall be by secret ballot.
  • Section 16(f):A candidate may withdraw from the election at any time prior to its commencement only.

8. Membership Requirements

  • Section 8.1: In order for a person to be deemed a member, at least one of the following shall apply:
  • Section 8.1(a): That person must have a Tiv father or mother, be a wife or husband of a Tiv son or daughter.
  • Section 8.1(b): That person self identifies as Tiv and is approved by the Executive Committee.
  • Section 8.1(c): Upon recommendation by the Executive Committee that person has been accepted as a member by a majority at general or emergency general meeting.

  • Section 8.2: The Society shall be at liberty to collaborate with members of the following types of Associations:
  • Section 8.2(a): A social, cultural or economic association whose membership is exclusively Tiv and whose aims and objectives are not in conflict with the provisions of this constitution.
  • Section 8.2(b): A social, cultural or economic association whose membership is not exclusively Tiv, but whose aims and objectives are not in conflict with the provisions of this Constitution, and who upon a recommendation by the Executive Committee has been accepted by a Special Resolution. 

  • Section 8.3: Relatives of members who have not yet attained the age of 18 may participate in the activities of the Society, but to a limited extent. They will not be required to pay dues and will not qualify to contest for or to vote in election.

  • Section 8.4: Honorary members can be appointed by the Executive Committee and shall be ratified by majority at an emergency meeting or a general meeting. Such honorary members will enjoy all the privileges of the Society but will not be entitles to vote or be voted for in elections and will not be required to pay membership dues.
